An aggressive environmental group is losing a lawyer and KSL TV is losing a political reporter as a Utah power couple head to Colorado.
Heidi McIntosh, John Daley and their 9-year-old daughter plan to relocate sometime this holiday season after McIntosh accepted a job as the managing attorney for Earthjustice’s Denver office, where she will lead a team of litigators focused on environmental issues throughout the Intermountain West.

A planned three hour power outage in Moab early this morning, lasted a little more than an hour..much to the delight of local law enforcement and operators of all night businesses. Rocky Mountain Power did planned maintenance on a substation near Moab.
>>Taking A Bite Out Of Crime Statistics

(Salt Lake City, UT) -- Crime statistics are on the decline around the U.S. and in Utah. The FBI's annual Crime in the U.S. Report found violent crimes fell four-percent last year while property crimes fell one-percent. In Utah, violent crimes dropped more than seven-percent, with the exception of homicides which rose two-percent. Utah property crimes were down more than five-percent in 2011.

>>Report Calls Utah's Teachers Union 'Weak'

(Salt Lake City, UT) -- A new report finds Utah's teachers union one of the weakest in the nation. The Thomas B. Fordham Institute, a Washington, DC think-tank, released its new study of teachers union across the country. It ranks Utah's union 39th and labels it "weak." The report said the low ranking reflects the union's poor resources, membership and perceived influence.

>>Activist Jailed For Assault On Girlfriend

(Salt Lake City, UT) -- An environmental activist in Utah is sentenced to jail for a 2008 assault. Jeffrey Salt says he acted in self-defense when he tried to break up with his girlfriend. A judge ordered Salt to spend 90 days in jail.

>>SLC Volunteer Heads East To Hurricane

(Salt Lake City, UT) -- Volunteers from Utah are heading east to help those effected by Hurricane Sandy. A volunteer worker from the Salt Lake City Red Cross said they'll stay to help in Albany, New York for about three-weeks. Power's been lost to more than two-million people along the east coast due to the storm and some areas are experiencing heavy floods.
>>LDS Church Helps With Storm Relief

(Salt Lake City, UT) -- The Church of Jesus Christ of Latter-day Saints is doing what it can to help super-storm Sandy victims. A warehouse in Maryland is stocked with food and emergency supplies for residents in the hardest hit areas. Both members and non-members are encouraged to seek help. The LDS church is also organizing a website where volunteers can sign up to help with the relief efforts.

>Fugitive Wanted For Deadly Shooting Turns Himself In

(Salt Lake City, UT) -- A fugitive wanted for a deadly shooting at a west Salt Lake party is behind bars. Police say Phillip James Lucero turned himself in yesterday afternoon after the incident over the weekend. His photo and a description had been published by many news organizations. Authorities suspect Lucero shot 20-year-old Valentin Sigala, Jr. to death early Sunday morning.
(Salt Lake City, UT) -- Utah Democrats are telling voters if they choose Senator Orrin Hatch, they will be voting for death. The party sent a news release today saying Hatch took campaign donations from 12 of the 13 corporations the website brainz.org lists as the world's most deadly. The group claims Hatch voted in ways that favored those corporations. Hatch's campaign manager told the "Salt Lake Tribune" Hatch's Democratic opponent Scott Howell and his Democratic friends are losing their "grip on reality."

WEST POINT — A West Point man is in serious condition after a pickup he was working on fell on top of him when the jack he was using failed.
The 42-year-old male, whose name has not been released, was working between the wheel and the left fender of the truck with the vehicle jacked when the vehicle fell on top of him.
Travis Fausett, who was working on the car with the man, said the two had the truck jacked up, but it "slipped off somehow" and pinned him.
 
NEW YORK - Airlines hastily canceled flights in the Northeast Sunday as Hurricane Sandy moved up the coast. The massive storm threatens to bring a near halt to air travel for at least two days in a key region for both domestic and international flights.
Major carriers such as American Airlines, JetBlue and Delta planned Sunday night to cancel all flights into and out of three area airports in New York
Utahans are stuck on the East Coast because of cancelled flights and there are visitors to Utah stuck here as well. The frustrating part for everyone is not knowing when they'll get home. Here in Utah, every major airline listed cancellations for Philadelphia, New York, Baltimore, Boston, and Washington.

Utah’s texting-while-driving law has been called one of the toughest in the nation.
The class C misdemeanor charge can be heightened to a class B misdemeanor or even a third-degree felony if the offender causes bodily harm or death while texting and driving.
But prosecutors say the narrow construction of the 2009 law has made it almost impossible to get convictions.
But an amended version of the law, which took effect May 8, makes it illegal to be doing anything on a hand-held wireless communication device except making or receiving a call, or using GPS navigation.
That means a driver may not use a cellphone to send data, read a text, use an app or view an image. And that should make it easier for prosecutors to prove cases in which such devices are suspected to have distracted a driver.

SALT LAKE CITY — Though the hurricane may be far away, for local Red Cross volunteers, the disaster hits right at home.
Mandatory evacuations have been ordered in New Jersey, the New York subway system has been shut down as a result of Hurricane Sandy
. About 100 local volunteers in Utah at the American Red Cross are preparing to assist with rescue efforts. Two have already been deployed to New York. To help the Red Cross' efforts, text 9099 for a $10 donation, or go to redcross.org.
>>West Jordan Party Turns Violent

(West Jordan, UT) -- Police are investigating a West Jordan party that turned violent. Cops heard shots as they arrived on a loud noise report early Saturday. A vehicle left the scene on West Pauline Way, and those in the home wouldn't come out. A SWAT team got in and ended the standoff. Those arrested face a number of misdemeanor charges, including disturbing the peace, and resisting arrest.

>>Man Killed By Box Elder County Deputies Was From Sandy

(Corinne, UT) -- The man shot and killed by Box Elder County sheriff's deputies is 52-year-old Troy Clark Burkinshaw of Sandy. Box Elder County Sheriff Lynn Yeates says a deputy tried to talk to Burkinshaw when he was seen urinating off Highway 13 Friday in Brigham City. Authorities say he drove off and was chased to Corinne. After he was stopped Burkinshaw allegedly tried to run over the deputy and was shot.

>>Zion Climber Falls To His Death

(Zion National Park, UT) -- A man is dead in a more than 40-foot fall in Zion National Park. Forty-nine-year-old Lyle Dale Hurd the Third was with three other people Friday on the Northeast Buttress route below Angels Landing. 911 was called and a member of his group gave medical help. The body was removed by search and rescue crews.

>>Rededication Of Crash Monument

(Antelope Island, UT) -- Family and friends from around the country are remembering those killed 20 years ago in a helicopter crash off Antelope Island. They came together this weekend to rededicate the monument to the 12 Air Force special operations troops and Army Rangers, who died October 29th, 1992, on a training exercise. None was from Utah but were from military installations in Florida, Georgia and North Carolina.

>>Officer In Car Crash Out Of Hospital

(West Valley City, UT) -- A Unified police officer is out of the hospital after a crash in a police car in West Valley City. The officer was on duty Saturday, reportedly driving with lights and siren. Police say a 17-year-old driver failed to yield and was cited.

>>Two Men Face Charges In LDS Church Stabbing

(Holladay, UT) -- Two men face charges in connection with last August's deadly stabbing outside an LDS Church in Holladay. Austin Taylor and Ryan Curtz each plead guilty to one count of second-degree obstruction of justice and assault. The alleged killer, Talon Levi Hamann, has already been charged with first-degree murder for the death of 25-year-old Michael Workman. Taylor and Curtz will be sentenced December 17th.

>>Ogden Man Charged With Girlfriend's Death

(Ogden, UT) -- Charges are filed against an Ogden man after he allegedly fatally beat his live-in girlfriend. Jeffrey Dean White faces one-count of third-degree murder for the death of 38-year-old Marnie Stark. White also faces domestic violence in the presence of child because his two children ages seven and nine were present in the home at the time of the killing.

>>Four Road Warriors Busted For Marijuana In SLC

(Salt Lake City, UT) -- Four cross country travelers are busted in Salt Lake City after authorities find them with eleven-pounds of marijuana. The finding was made during a routine traffic stop at Salt Lake City International over the weekend. The four were traveling from California to Detroit when they encountered car trouble. They then tried to rent a car but a background check led police to search their vehicle and that's when the pot was discovered.

>>Ogden Businessman Wants To Liven ThIngs Up

(Ogden, UT) -- An Ogden entrepreneur's plans to revive an old strip mall with live music is on hold for now. Earnie McKown had to shut his Paris Cafe in the Harrison Plaza Shopping Center in downtown Ogden earlier this year. But McKown is asking City Councilors to rezone the mall so it can host live entertainment in a vacant storefront. The venue would be a nonalcoholic social club and serve as a hang out for teens.

CALGARY, Alberta — The Church of Jesus Christ of Latter-day Saints dedicated their 140th temple, and their third temple in Alberta.
The temple was dedicated Sunday morning by Thomas S. Monson, who also performed the traditional cornerstone ceremony earlier that morning. Local church leaders and members gathered for the dedication Sunday, and for the cultural celebration Saturday

GRAND 48, MILLARD 33: Grand led the entire way and pulled away for good in the final two minutes after Millard missed a two-point conversion attempt that would've tied the game at 35-35 with under three minutes remaining. Wesley Rodda increased the lead to 41-33 with his second TD reception of the game a few plays later, and then Aaron Randall tacked on an interception for a touchdown to seal the victory.
MANTI 38, BEAVER 7: Manti got help from everyone Friday night, picking up touchdowns from five different players in the blowout victory in the 2A quarterfinals. The Templars had 127 yards rushing, with 208 yards passing to down the visiting team. Manti held Millard to less than 50 yards rushing in the 2A Playoffs.
Grand Manti are in the first Game of the 2-A semi finals Saturday at 11am at SUU's Stadium in Cedar City.
 
SAN JUAN 56, EMERY 13: Barkley Christensen had three rushing touchdowns, and also threw for a pair of TDs, as San Juan managed to outscore Emery 42-7 in the first half to cruise to victory. Logan Meyer and Bobby Bowring each finished the game with a pair of scores, as the Broncos dominated for the 2A Quarterfinal win.

San Juan and South Summitt will play in the 2-a Semi's at 2pm in Cedar City.
MONTICELLO 41, SUMMIT ACADEMY 6: Monticello scored all 41 points in the first half, and were able to cruise past Summit Academy to advance in the 1A Playoffs.

>>Report: Man Had Serious Firepower Before Shot

(Salt Lake City, UT) -- The man shot by police on a TRAX Station platform after threatening to detonate an explosive device in his backpack indeed had enough firepower to scatter debris more than a block in each direction. Anthony Kenshiro Mayhew's device never had a chance to detonate as a SWAT officer fired his rifle once, killing Mayhew. He was demanding Salt Lake City police investigate his claims he was being monitored by the federal government. A report by the Salt Lake County District Attorney's Office said Mayhew's makeshift device included 15 shotgun shells

>>West High Grieves Over Classmate's Death

(Salt Lake City, UT) -- Students from West High School are still grieving over the loss of a classmate. Fourteen-year-old freshman Edwin Cardoso was killed Wednesday morning while crossing the street on his way to school. A group of Cardoso's closest friends gathered yesterday for a moment of silence and grieving.

>>Utah Prez Announces New Initiatives At Address

(Salt Lake City, UT) -- The President of the University of Utah announced sweeping new initiatives for the institution yesterday at his inaugural address. Calling students the "number-one job," President David W. Pershing said he wants to ensure his students get a solid education at a price they can afford while maintaining the university's identity as a world-class research institution. Pershing said it starts by limiting undergraduate admissions only to students who show they will succeed in college.

>>Slick Roads Cause 16-Vehicle Pileup

(Salt Lake City, UT) -- The eastbound Interstate 80 on-ramp in Salt Lake City is closed after a multi-car pileup. Highway Patrol says slick roadways are to blame for the wreck involving as many as 16 vehicles. Officials closed the Wright Brothers Drive interchange to investigate. Only minor injuries are being reported.

>>Utah Native Dies In Afghanistan

(Salt Lake City, UT) -- An Army Green Beret sergeant and Salt Lake City native has died in combat operations overseas. Officials with the U.S. Department of Defense say Sergeant First Class Ryan Savard died in a firefight in Afghanistan on October 12th. The 29-year-old was serving his fourth tour after having served a tour in Iraq. Savard is survived by his wife, Kayla.


>>Powell's Siblings Seek Insurance Funds

(West Valley City, UT) -- Josh Powell's siblings are hoping to cash in on his insurance policy. Powell's wife, Susan, disappeared in 2009 before he killed their children and himself. Powell had insurance policies worth more than three-and-a-half-million dollars on his family but changed the beneficiary from himself to his siblings. Susan's family is fighting to make sure the Powells don't profit from the deaths.

>>State Officials Issue Fish Advisory

(Salt Lake City, UT) -- State officials are warning locals about elevated mercury levels found in striped bass. The affected fish were found in Lake Powell and the Quail Creek Reservoir. Officials issued an advisory yesterday along with revised consumption guidelines. Pregnant women and children under the age of six are urged to not eat more than four-ounces of striped bass per month due to potential neurological effects. >>Fundraiser Held To Benefit Eagle Mountain Man

(Eagle Mountain, UT) -- A fundraiser will be held this weekend to benefit the Eagle Mountain man whose wife died while giving birth. Mike Roberts says his wife, Liz, died of rare complications during labor last week. On the same day, Roberts says he found out he may be losing his house. A fundraising event for Roberts and his family will take place today at 3671 Blackhawk Road and again tomorrow at Rockwell Charter School.
>>Early Snow Day In Morgan

(Morgan, UT) -- Officials in Morgan are saying they declared the first snow day of the school year. Morgan Schools Superintendent Ken Adams says about 12-hundred elementary students stayed home from school. Junior-high and high-school students had already arrived at school when the district decided to cancel classes for the younger kids.

SALT LAKE CITY — LDS Charities is donating more than $1 million in humanitarian aid to Syrian refugees who have fled to Jordan to escape civil war.
Service missions from The Church of Jesus Christ of Latter-day Saints in Jordan are now delivering humanitarian aid to the 200,000 refugees. These humanitarian efforts began in May, with the delivery of 2,500 hygiene kits to the people of the Zaatari Camp, located near the Syrian-Jordanian border.

SALT LAKE CITY — State officials Thursday issued an advisory regarding elevated mercury levels found in striped bass in two southern Utah bodies of water.
The warning includes fish in Lake Powell from Dangling Rope Marina, south to the dam in Kane and San Juan counties, and Quail Creek Reservoir in Washington County.

MOAB — Utah has joined a growing list of states that require energy companies to disclose which chemicals they employ in a controversial process used to stimulate oil and natural gas production.
The state Oil, Gas and Mining Board, by a unanimous vote, approved a new rule Wednesday that requires companies to use www.fracfocus.org
to report the amount and type of chemicals used to hydraulically fracture any Utah oil and gas well.
SALT LAKE CITY — Utah gave its final approval Wednesday for the first commercial tar sands project in the U.S., handing a victory to a Canadian company that aims to start producing 2,000 barrels of oil next year in the start of what could grow into a larger operation.
The Utah Water Quality Board upheld the decision of state regulators and turned back an appeal from a Moab-based environmental group that vows to take up its fight in the state courts.
Living Rivers has fought the project every step of the way, arguing that tar sands mining will contaminate groundwater in a largely undeveloped area of Utah's Book Cliffs region that drains into the Colorado River.
State regulators and the company insist the eastern Utah desert is so dry there is no significant groundwater to pollute. An administrative law judge agreed,

>>Roman Gets 10-Years On Two Lesser Charges

(Spanish Fork, UT) -- Acquitted of killing a Utah sheriff's deputy, Roberto Miramontes Roman will still spend up to ten-years behind bars on two lesser charges. Roman was acquitted in August in the killing of Millard County deputy Josie Greathouse Fox. At his sentencing yesterday, a judge handed Roman ten-years in prison on convictions for evidence tampering and firearms possession. Family and friends of the slain deputy said the sentence is small consolation.

>>Activist Enters Halfway House

(Salt Lake City, UT) -- The Salt Lake City environmental activist accused of fraudulently buying up oil licenses is now in a halfway house. Timothy DeChristopher has spent the last year in federal prison. The Bureau of Prisons granted the move to DeChristopher due to good behavior.

>>Alpine District Says Space Center Will Return

(Salt Lake City, UT) -- The Alpine School District says its popular Christa McAuliffe Space Education Center is closed but only temporarily. The district was forced to close the space center in August over safety concerns. More than 700-thousand dollars in repairs are needed. While the district says the center will re-open, just when remains a mystery.

(Salt Lake City, UT) -- The recent cool weather has Utah transportation officials thinking ahead to winter. A small mountain of road Salt was just stashed at a UDOT facility at Wasatch and 38th South. Workers are making certain their plows and blades are ready to go when Old Man Winter really does come.

(Salt Lake City, UT) -- Rape cases in Utah are above the national average. The latest numbers show nearly 70 out of every 100-thousand local women reported being raped. Holly Mullen of the Rape Recovery Center says victims often know their rapist. Alleged date rapist Greg Peterson committed suicide this week amid charges of sexually assaulting at least five women who he met on LDS dating sites.

>>Skiers Try Big Cottonwood Canyon

(Big Cottonwood Canyon, UT) -- Some skiers are already trying out the new snow in Big Cottonwood Canyon. Skier Alec Nelson says it's worth the effort, even though resorts don't plan to open for another month. Some parts of the Wasatch Mountains have more than a foot of snow. Up to six inches could fall today in Morgan County.

>>SLC-Area Foreclosures Dip

(Salt Lake City, UT) -- Salt Lake City's foreclosure rate continues to dip. Roughly one in every 275 homes was in default during the third quarter, according to RealtyTrac. That's a 41-percent decline from the previous quarter. The company credits a more stable economy and more homes being sold as short sales.

>>Soldiers Return Home From Afghanistan

(Salt Lake City, UT) -- Several Salt Lake City-area soldiers are spending their first weekend at home in nearly a year. Eight soldiers with the U.S. Army Reserve returned to the states four days ago after a tour in Afghanistan. Afterward, they had to go through post-deployment processing in New Jersey. The group was responsible for delivering letters to and from home while overseas.

>>Accused GOP Activist Free On Bail

(Salt Lake City, UT) -- A GOP activist in Utah charged with sexual assault is free on bail. Greg Peterson allegedly sexually assaulted five women. His bail was two-million dollars but normally someone has to come up with ten-percent which in this case would be 200-thousand. He's due in court November 2nd and must stay away from the alleged victims.

>>Robber Hits Provo Bank

(Provo, UT) -- Provo Police are hoping you can help catch a bank robber. The thief gave a note to a teller at a Wells Fargo Bank Saturday. He didn't show a weapon. The suspect is white, in his late 30s, six foot three, 230 pounds and had a dark brown beard.

>>Hunter Critically Wounded In Rifle Accident

(Ogden, UT) -- The Box Elder County Sheriff's Office is saying a Roy hunter accidentally shot and injured himself. The 53-year-old Roy resident was taking a black powder rifle from his truck in the Locomotive Springs Saturday area when it fired, striking him in the chest. The victim was in critical condition and was taken to an Ogden hospital.

>>Westminster College Welcomes New President

(Westminster, UT) -- There's a new president at Westminster College. Brian Levin-Stankevich was inaugurated Saturday. He is the school's 17th president. Levin-Stankevich spoke of the importance of a college education for personal improvement and a brighter economic future for the school's graduates. Levin-Stankevich is a native of Buffalo, New York and was also a chancellor of the University of Wisconsin - Eau Claire.

>>Historic House Has New Location

(Holladay, UT) -- Holladay's historic Casto house is getting a new home. The structure was moved by truck this weekend from Murray Holladay Road to City Hall Park. Workers are putting the mid 1800s house on a new foundation. The old location will be the site of a new fire station.


>>Four People Hurt When Man Steals Cop Car

(Salt Lake City, UT) -- Four people are hospitalized following a weekend car crash involving the theft of a Salt Lake City police car. Authorities say the officer was having a bite at the Flying J early yesterday morning when a man got in and sped out of the parking lot. The ensuing chase ended in a crash at 500 East and 33-hundred South. The conditions of the victims ranges from critical to stable.

>>Community Bands Together To Help Heal

(Lehi, UT) -- One Utah Community is banding together to help heal one of their own. Southern Utah University Student and dancer Kilee Krause remains in a medically-induced coma in Las Vegas hospital following the rain-induced accidents October 12th along Interstate 15. Krause struck a motorhome and spun into a guardrail in St. George. She'd recently been deciding whether to take a mission trip for the LDS Church.

>>Weekend Checkpoint Lands 15 Under Arrest

(Salt Lake City, UT) -- A weekend checkpoint lands five under arrest for DUI. Highway Patrol says they also made another ten arrests for drug offenses during the mandatory stop at the Utah-Nevada state line late Saturday night. One drug bust netted a 50-pound haul of marijuana.

SANTA CLARA — Friday, a Southern Utah teenager died after she was accidentally buried in the sand in Snow Canyon National Park. Sunday, friends remembered her by decorating her home with symbols of the girl's life.
Santa Clara resident, 15-year-old Whitney Webb was accidentally buried in sand while playing with her three siblings in the sand dunes of Snow Canyon. She died as a result of her injuries.
Around the neighborhood in which she lived with her family, friends are remembering the girl who touched each other their lives. Purple ribbons and bows decorated the houses, signs expressing love for the girl dotted lawns.
 HERRIMAN — After the Utah High School Activities Association ruled East High School be allowed to go to the playoffs and upheld their decision concerning Timpview High School's forfeits, Herriman High School released a statement asking the panel to reconsider their decision.
Friday, The Board of Trustees ruled that the seven-game forfeit would be lifted for East High, but the school will receive a $6,000 fine for allowing the ineligible player to participate in those games. They also will not be allowed to keep their Region 6 title, and coach Brandon Matich will be placed on a three-game probation.

The National Weather Service in Salt Lake City said a cold fall storm is on the way to Utah.
Come Sunday night, rain was expected across portion of northern Utah with snow about 9,000 feet.
As strong winds move into the state, snow levels will begin to lower across the north Monday night, and there is a potential for significant snow accumulation in the northern mountains through Thursday night, the weather service said.
The snow probably won’t reach the valley floors across far north Utah until late Tuesday. By Wednesday, the snow will likely extend across the central valleys.
Western Wyoming Mountains are expected to get up to 8 inches of snow.
Southeastern Utah will remain warm and dry all week.

>>Utah Unemployment Among Lowest In Nation

(Salt Lake City, UT) -- Utah's rate of unemployment is now among the lowest in the country. The rate fell to five-point-four-percent in September, its lowest since the Great Recession started in 2007. It was also the second significant drop in as many months after being stuck at six-percent.

(Moab-Blanding Utah))_ The uranium mine layoffs reported on yesterday are more widespread in Southeastern Utah than first thought. Instead of 16, its now reported that Forty Energy Fuels employees will be laid off from the firm’s Beaver, Daneros and Pandora mines, according to company officials.
Layoffs at Beaver and Daneros will be effective the end of this month. Employees at Pandora will likely continue working until January or February, Energy Fuels spokesman Curtis Moore said.
The Pandora and Beaver mines are near La Sal. Daneros is 40 miles west of Blanding, about four or five miles south of Fry Canyon.
The layoffs result from low uranium prices, Moore said.
The affected mines will be shut down and placed on “standby” status. A few maintenance workers and mangers will stay on site to make sure the mines can re-open quickly if prices improve, Moore said.

(Murray, UT) -- The driver of an SUV lay in critical condition this morning after a collision with a semi on Interstate 15 in Murray. Both ramps of I-15 at 53-hundred South had to be closed yesterday as crews worked to extract the female driver from her SUV which became wedged underneath the semi. While the driver remains critical a second woman her two children riding inside the SUV needed treatment for only minor injuries.

(Provo, UT) -- Texas Congressmen and former presidential hopeful and Ron Paul energizes a large crowd at Utah Valley University. Supporters cheered inside the Events Center as Paul laid into the Federal Reserve, income taxes, the war on drugs and welfare. Paul said he believes personal freedom and civil liberty are not just ideas embraced by Republicans.

>>Report: Salt Lake 'Ready' To Bid On '26 Olympics

(Salt Lake City, UT) -- Will Utah once again be home to the Olympic Village? According to a new report by the Utah Olympic Exploratory Committee the state is "ready, willing and able" to host the 2026 Winter Games. The committee presented its findings yesterday to Governor Hebert and Salt Lake City Mayor Becker. The report says Salt Lake City's economy would benefit by five-billion-dollars if the Games returned here. The Governor isn't expected to decide until November whether or not Utah should make a bid.

TAYLORSVILLE — A 39-year-old woman was killed Thursday night when she stepped off the curb in front of an oncoming car.
Unified Police Lt. Justin Hoyal said the woman was hit about 10 p.m. while attempting to cross to the north side of 5400 South
near the intersection of 2100 West. The woman was not at a crosswalk, and there were no nearby streetlights.

A federal grand jury has indicted a former FBI agent who prosecutors claim tried to derail a criminal investigation into a key figure in an alleged military fraud scheme.
The grand jury in Salt Lake City on Thursday returned an 11-count indictment charging former FBI special agent Robert G. Lustyik Jr., and two alleged accomplices, each with one count of conspiracy, eight counts of wire fraud, one count of obstructing justice and one count of obstructing an agency proceeding
Prosecutors suspect that Lustyik, 50, used his position as an FBI agent to try to thwart an investigation into Michael L. Taylor, 51, with whom he had formed what promised to be a lucrative business relationship that would land them security and alternative energy contracts throughout the world.
 
 
>>WVC Man Arrested In Duel Attack

(West Valley City, UT) -- A West Valley City man is accused of beating his estranged wife and then stabbing her brother. The 46-year-old man was charged yesterday with felony aggravated assault, criminal trespassing and a slew of other charges. Police say he trespassed on his wife's property and then hit her after she called 911. He then allegedly grabbed a steak knife from the kitchen and attacked the woman's brother, who was outside. Both victims were hospitalized with non-life-threatening injuries, and the husband was arrested at his home.

>>BYU Tuition To Rise Three-Percent

(Provo, UT) -- Brigham Young University students face a three-percent rise in tuition next academic school year. The increase will help cover rising costs throughout the university, according to BYU spokeswoman Carri Jenkins. She tells the "Deseret News" that the extra revenue will allow the university to "continue to provide superb education" to its students. Despite the increase, BYU remains cheaper than most private American colleges and universities.

>>Magna House Fire Under Investigation

(Magna, UT) -- The cause of a two-alarm house fire in Magna is under investigation. The blaze broke out yesterday morning in the attic of the home at 2752 South 9000 West. Crews had it under control within 20 minutes. The residents were not home at the time. Investigators were trying to locate them to help determine a cause.

>>UofP To Close Two Utah Locations

(Salt Lake City, UT) -- The University of Phoenix is planning on closing a number of campuses nationwide, including two in Utah. Locations in St. George and Pleasant Grove are closing their doors due to declining enrollment. Administrators say overall, 25 main campuses and 90 smaller learning sites will be shuttered nationwide. They say the move will save the for-profit university 300-million dollars a year.

>>UT Principal Honored In DC

(Washington, DC) -- A principal from Highland is heading back from Washington D-C where he was honored as one of the top principals in the country. James Melville of Freedom Elementary has served the past 31 years in education. He is one of roughly 60 principals to be recognized yesterday at the National Meeting of Principals of the Year. Teachers and staff at Freedom say Melville was chosen because of his effort to keep a sense of community within the school.

MOAB — An Australian BASE jumper who got snagged on a Moab canyon wall in Left Hand Canyon off Millcreek. was rescued by friends Wednesday afternoon.
Grand County Sheriff Steven White said the man's parachute got caught during a jump about 3:30 p.m., leaving him hanging 250 above the ground. Because there is not road access to the canyon, crews from Grand County Search and Rescue and the National Park Service set out on foot to try to reach the stranded man.
When they arrived, they found that the man's friends had rappelled down to where he was caught, freed him and lowered him to the ground.
A Department of Public Safety helicopter that had been deployed from Salt Lake City to assist in the rescue transported the man to Moab Regional Hospital, White said. The BASE jumper sustained minor injuries to his feet.

(Moab Utah)- Reports are circulating today that up to 16 miners at the Energy Fuels Deneros Mine, west of Blanding will be laid off at the end of October. They are employees of Reliant Resources of Moab...a sub contractor for Energy Fuels. A steady decline in the world Uranium Market is cited as the cause. This action comes just after Energy Fuels purchased all of Dennison Mines properties and other mines in the area.

>>Deadly South Temple Gas Station Fight

(Salt Lake City, UT) -- A 62-year-old man is dead after getting into a fight with another customer at a Salt Lake City gas station. The altercation happened yesterday evening at Smith's Express on South Temple. Police say no weapons were involved in the melee. They're currently reviewing surveillance footage to determine how the man died. No arrests have been made.

>>Man Who Carjacked Porsche Charged

(Millcreek, UT) -- Aggravated burglary and other charges have been filed against a West Valley City man who allegedly stole a Porsche at gunpoint. Matthew Cardenas was charged yesterday in connection with the October 5th carjacking in Millcreek. In addition to the fancy sports car, police say Cardenas took the owner's iPhone and wallet. He was arrested after allegedly leading police on a high-speed chase through a Salt Lake City neighborhood.

>>Man Tries To Open Door On Flight

(Salt Lake City, UT) -- A Ukrainian man says he'd been hitting the sauce for 50 days before he went crazy on a plane and tried to open the emergency exit. Federal charges have been filed against the Ukrainian national, who arrived in Salt Lake City Monday on a Delta flight from Boston. Witnesses say he suddenly woke up and started screaming in Russian. He says he thought a wing was on fire, so he ran to the back of the plane and tried to use the emergency exit.

>>Teachers Convention Underway In Sandy

(Sandy, UT) -- The Utah Education Association's annual gathering is underway in Sandy. The event will feature hands-on learning activities for kids and workshops for parents. The convention will also hold a fashion show for teachers and free haircuts, massages and manicures for members. It takes place today and tomorrow at the South Town Exposition Center.


>>Brigham City Man Found In Toxic Sludge Pool

(Lava Hot Springs, ID) -- The body of a Brigham City man last seen over the weekend has been found at the bottom of a toxic sludge pool in Idaho. Workers at Whitaker Construction Company in Lava Hot Springs, Idaho say they spotted tire tracks leading to the pond and got suspicious. When authorities drained the pond they found a truck under 16-feet of sludge and inside 61-year-old Shelby Whitaker, the cousin of the company's CEO. Investigators are still determining how Whitaker ended up there.

>>Lawmaker Wants Prison Inmates To Be Organ Donors

(Salt Lake City, UT) -- Utah could be added to a growing list of states where prison inmates are allowed to donate their organs when they die. The bill proposed by Utah Representative Steve Eliason would allow inmates to voluntarily agree to donate their organs, but only posthumously. An interim criminal justice committee in the Utah Senate approved the Inmate Medical Donation Act yesterday. According to the "Tribune," more than 100-thousand people are on waiting lists for organs nationwide.

(Salt Lake City, UT) -- Utah lawmakers are standing up against people who intentionally ruin their marriage in hopes of getting alimony payments. According to the "Deseret News," State Representative Fred Cox of West Valley City is proposing the "Alimony Amendments" bill that would give judges the ability to consider fault when determining alimony. Senator Lyle Hillyard said holding someone responsible for alimony when their spouse cheated on them is unfair.

>>Hundreds Attend Funeral Services For Slain Border Patrol Agent

(Spanish Fork, UT) -- Hundreds of people gathered at a the Spanish Fork Cemetery yesterday to pay their respects to slain border patrol agent Nicholas Ivie. The Utah native was accidentally shot and killed last week in a well-known smuggling corridor near the Arizona-Mexico border. His funeral service was held at Utah Valley University's basketball center that morning, followed by a procession to the cemetery. Several hundred Boy Scouts, war veterans and law enforcement officials from across the nation were in attendance.

>>Candidates Spar In Last Gubernatorial Debate

(Salt Lake City, UT) -- Utah's top two candidates for governor have squared off in their final debate before Election Day. Governor Gary Herbert, who's seeking his first full term since assuming the post in 2009, pointed to his record of growing the state's economy. Democratic challenger Peter Cooke, a retired Army general, slammed Herbert for not making education a priority. The general election will be held on November 6th and early voting begins on October 23rd.

>>Kearns Forster Mother Accused Of Having Sex With Teenage Sons

(Salt Lake City, UT) -- A Kearns woman is accused of having sex with two of her teenage foster sons. Delshawn Little was charged yesterday with felony rape and forcible sodomy. The alleged incidents occurred three times with one of the boys and once with the other. A second woman who allegedly engaged in sexual activity with Little and her two sons is also facing felony charges.

>>Section Of Mountain View Corridor To Open Early

(Salt Lake City, UT) -- The large section of the Mountain View Corridor in Salt Lake County is opening up two months early. UDOT opened the first-two-mile section of the corridor earlier this year and will open up another seven miles tomorrow. The route from Porter Rockwell Boulevard at 16-thousand South to Old Bingham Highway features fresh asphalt, bike lanes and trails. An additional six miles is set to open by the end of the year.

>>Man Arrested In American Fork Road Rage Attack

(American Fork, UT) -- A man is accused of repeatedly punching a woman after a road-rage incident in American Fork. Police say the 39-year-old man rammed the woman's car on 700 North on Wednesday, causing him to lose control and flip his vehicle. They both got out, and the man allegedly started punching the victim in her back. A passer-by called police, who later arrested the suspect on suspicion of aggravated assault. Neither driver was seriously injured.

>>Judge Orders MacNeill Stand Trial For Wife's Death

(Provo, UT) -- A judge in Provo is ordering Martin MacNeill stand trial for the murder of his wife. Fourth District Judge Samuel McVey said there's probable cause to believe Michelle MacNeill died by drowning at the hands of her husband. Michelle MacNeill was found dead in 2007. The case is largely built around circumstantial evidence but the judge said MacNeill's unusual actions have created valid suspicion.

>>Man Re-United With Goat

(Salt Lake City, UT) -- A man from Washington State is reunited with his pet goat this morning in Salt Lake City. Authorities impounded the animal earlier this week after Steve Westcott leashed his goat named LeeRoy outside a Salt Lake bar. Westcott paid a 50-dollar fine yesterday which he says was avoidable. Westcott says he brought the goat to Salt Lake for a fundraiser for an orphanage in Kenya.

>>Christmas Concerts To Feature Brokaw, Boe

(Salt Lake City, UT) -- The annual Christmas concerts by the Mormon Tabernacle Choir will feature several heavy-hitters this year. Tony Award-winner Alfie Boe and veteran TV journalist Tom Brokaw will be among the dignitaries at the concerts scheduled for December 13th through 15th. The two are also scheduled to accompany the choir for the Sunday morning broadcast on the 16th.
HERRIMAN — A 38-year-old man is in serious condition after crashing a pickup truck through two fences and two backyards near
Rocky Point Drive (13765 South) and 5600 West Thursday night.Police say the truck crashed though the fence about 8:30 p.m., drove through a home's backyard and crashed through another fence into the backyard of a house at the corner of Draft Horse Court and 5600 West. The driver was transported to Intermountain Medical Center by medical helicopter.
Officers said alcohol was a contributing factor in the crash.

The permit will the allow three firms to seek financila backers for their projects with a deadline of the end of the year. The largest project plans 27 wind turbine towers, at least 500 feet tall...just north of Monticello.

>>Utah Congressman Visits Libya To Investigate Ambassador Killing

(Salt Lake City, UT) -- Utah Congressman Jason Chaffetz [[ CHAY-fets ]] says a recent visit to Libya leads him to believe the Obama administration is not being truthful about an attack that killed four Americans. The Republican traveled to Libya over the weekend to get an on-the-ground assessment of the attack. He says many Americans he talked to in Libya say they were repeatedly denied by Washington when they asked for upgraded security around the consulate. Chaffetz will be part of a House hearing today that will investigate the deadly attack.

>>First Death From West Nile Virus Reported In Utah

(Box Elder Co., UT) -- State health officials are confirming the first deadly human case of West Nile virus this season. Officials say an elderly man in Box Elder County succumbed to the disease. It's the fourth West Nile case in that county this season. People are advised to wear long-sleeved shirts and pants when outside and to use insect repellent with DEET to avoid getting bitten by mosquitoes, which can carry the virus.

>>UT Man Arrested At Kids' Soccer Game Over Ref's Call

(Payson, UT) -- A volunteer football coach is accused of tackling a young player on his son's opposing team. Police say Nate Harris was coaching a game between the Payson City and Mapleton City football leagues last Saturday when he stepped onto the field and knocked a 13-year-old player down with his forearm. The boy was hit so hard, he suffered a concussion. Harris was ejected from the game and arrested on suspicion of second-degree felony child abuse.

>>Senator Dayton Writes New Abortion Bill

(Salt Lake City, UT) -- A state senator is sponsoring legislation to prohibit women from getting an abortion simply because they aren't happy with the sex of their baby. The bill, called "Gender Selection Abortion Prohibition," could be introduced during January's legislative session. It would reportedly impose fines and prison terms on doctors who perform gender-selective abortions. Republican Senator Margaret Dayton says similar legislation has been passed in several other states.

>>Not All Mormons Favor Romney

(Salt Lake City, UT) -- Not all Mormons want to put Mitt Romney in the White House. That's according to BYU senior Ben Ader who tells KSL-TV that religion and politics don't always mix. He's one of many college students and self-proclaimed Democrats who believe there is a generational gap in the church and young people are raised to be more open-minded. According to a recent Gallop poll, 84-percent of registered Mormon voters plan on choosing Romney, who's a member of the Church of Jesus Christ of Latter-day Saints. The LDS Church has not endorsed a candidate.
SALT LAKE CITY — EnergySolutions has announced the elimination of about 265 jobs from its worldwide workforce, starting with layoffs at its cleanup facility in Tooele County.
One former employee estimated about 60 employees at the Clive facility were dismissed Monday.
Mark Walker, vice president of marketing and media relations for EnergySolutions, said the layoffs are part of a dramatic reduction and restructuring throughout the company. EnergySolutions employs about 5,000 people worldwide,

>>LDS Leader Urges Protection For Children

(Salt Lake City, UT) -- An LDS apostle is calling for everyone, including non Mormons, to protect children. Dallin H. Oaks addressed to the LDS General Conference in Salt Lake City. He told the gathering children, quote, "need decision makers who put their well being ahead of selfish adult interests. The "Salt Lake Tribune" reports Oaks says abortion is "a great evil" and says single and same-sex parenthood put kids at a disadvantage.

>>Mormon Leaders Lower Age For Becoming Missionaries

(Salt Lake City, UT) -- The Mormon Church is lowering the age for young Americans to serve full-time missions in hopes of growing the Church's presence worldwide. Church of Jesus Christ of Latter-day Saints President Thomas Monson announced that 18-year-old men and 19-year-old women from the U.S. will be eligible to serve as full-time missionaries. Mormon men in 48 countries have been eligible to serve at age 18 for about ten years, but this is the first time American Mormons will have the same opportunity. The change is effective immediately.
>>LDS Mission Requirement Benefits Student-Athletes

(Salt Lake City, UT) -- The LDS Church's new minimum requirement for missionary service is having a dramatic effect on student athletes at BYU. School officials say the new requirement that missionaries be at least 18-years-old means student-athletes can depart and return sooner and play their sport of choice four straight years. BYU football coach Bronco Mendenhall has nearly 40 players on mission trips in more than a dozen countries.

(Salt Lake City, UT) -- The retired submarine USS Salt Lake City may find a permanent home at Library Square. The Utah Chapter of World War Two and Retired Nuclear Submarines is asking the Salt Lake City Library Board of Directors to locate the deck and the conning tower as a memorial downtown. The library board can only made a recommendation and the site has raised controversy.

>>Chase Through Salt Lake Ends In Arrests

(Salt Lake City, UT) -- Two men are facing several possible charges after police chased them along Salt Lake streets and on Interstate 80 at speeds up to 120-miles-per-hour. It began Friday when a woman driving a Porsche was carjacked. The two suspects abandoned the car. One was Tasered and caught after a foot chase, and the other was found behind a shed.

(Salt Lake City, UT) -- Salt Lake City is one of the stops along a 35-hundred-mile journey for Barrett Keane. He's going from Miami, Florida across country to San Francisco and he's doing it on foot. Keane hopes to raise money for school uniforms for kids in Haiti and Uganda so they can attend school. >>Border Investigators: Ivie Shot By Fellow Agents

(Sierra Vista, AZ) -- The Utah-born U.S. Border Patrol agent killed in an Arizona border incident last week was fatally shot by his fellow agents. The head of the Border Patrol agents union made public yesterday the startling revelation. The union says agent Nicholas Ivie fired at two agents Tuesday, wounding one, after he mistook them for smugglers just north of the border near Bisbee, Arizona. Ivie was killed when his comrades allegedly returned fire. Homeland Security Secretary Janet Napolitano joined other high-ranking officials in meeting Ivie's family Friday to discuss the investigation. Chris Ivie tells the "Deseret News" Napolitano assured the family the incident was a, quote, "tragic accident ? nothing more."

>>General Conference Of LDS Church Ends Positively

(Salt Lake City, UT) -- The 182nd Semi-annual General Conference of the LDS Church closes with the positive message from President Thomas Monson for all to, quote, "be of good cheer." The 85-year-old church leader spoke before a capacity crowd yesterday inside the 21-thousand-seat Conference Center in Salt Lake City. An estimated 100-thousand people attended the weekend church events.

>>Fire Starts In Ogden Canyon

(Ogden, UT) -- Flames break-out in Ogden Canyon on the final day of the Utah fire season. The cause remains unknown but officials say hikers were reportedly in the vicinity of yesterday afternoon's fire. It started on the side of a hiking trail. Crews were still on scene last night as flames moved eastward. About 20 acres have been burned so far.

WEST VALLEY CITY — A 20-year-old woman was killed Sunday morning in an accident on Bangerter Highway.
Yesica Moreno of West Jordan was driving northbound near 2350 South shortly before 6 a.m. when her small pickup truck crossed into southbound traffic and struck the side of a semi tractor-trailer, West Valley City Lt. Bill Merritt said.
Moreno was airlifted to a nearby hospital where she was pronounced dead, Merritt said. The driver of the tractor-trailer was shaken but not injured, he said.

Chilly nights are expected to continue across parts of Utah.
The National Weather Service in Salt Lake City said people living in the Salt Lake and Tooele valleys, along the Wasatch Front, the Western Uinta Basin, Castle Country, the San Rafael Swell, west central Utah, Sanpete and Sevier valleys and extreme southwest Wyoming can expect to see frost overnight
The weather service recommends people in those areas cover or bring in cold-sensitive plants, provide shelter for pets or bring them inside, disconnect hoses from faucets and drain and winterize swamp coolers.

Provo Man Identified As Border Patrol Agent Killed In Arizona
(Bisbee, AZ) -- A Border Patrol agent shot and killed near the Arizona-Mexico border has been identified as a one-time Utah resident. Nicholas Ivie, who grew up in Provo, was killed in an early morning shootout about 100 miles south of Tucson, Arizona. A second agent was wounded and treated for non-life-threatening injuries. In a statement to FOX 13, the Ivie family said: “We are extremely proud of Nick and for his service both in his community and our country. He loved what he did and gave it his all, including his life. Right now our thoughts and prayers are with his wonderful wife and his two beautiful girls. We would also like to thank everyone for the tremendous outpouring of support and love.” Ivy was active in his LDS Ward, serving as second counselor in the ward Bishopric.

>>Orem Man Sentenced In Murder-For-Hire Case

(Provo, UT) -- An Orem man could be spending life in prison after being sentenced in a murder-for-hire case. Yuri Lara was sentenced to five-years to life after pleading guilty to manslaughter for hiring two men to hurt 32-year old Andy Purcell, who he thought was a police informant. Lara also pleaded guilty to four first-degree felony drug charges.

>>Whooping Cough Cases Hit Pre-Vaccine Levels

(Salt Lake City, UT) -- Whooping cough cases in the state are at their highest levels in more than 60 years. The Utah Department of Health has reported 851 cases of pertussis, a highly contagious bacterial desease which can result in violent coughing fits that can last for weeks. It's the most recorded cases of the illness since 1946, before there was a vaccine. No deaths have been reported in Utah, but The Center for Disease Conrol reports 14 deaths nationwide from the worst whooping cough outbreak in 50 years.

>>Base Jumper Rescued in Provo Canyon

(Provo, UT) -- A man stranded on a cliff in Provo Canyon is safe after sheriff's crews were able to rescue him early yesterday morning. Utah County Sheriff's officials say 26-year-old Adam Gardner, a base jumper called police and told them he had broken his ankle after his parachute got caught on a cliff. It took four hours to rescue Gardner, who was taken to a nearby hospital.

>>Rasmussen Is Named Utah State Parks Deputy Director

(Salt Lake City, UT) -- Utah has a new state parks Deputy Director. Jeff Rasmussen, who has worked for the department for two decades was named to the post by Utah State Parks Director Fred Hayes. The position has been vacant since April when Hayes became director.
 
>>Polygamous Sect's Trust Battle Dealt Major Blow

(Salt Lake City, UT) -- Utah's high court hands the polygamous sect led by Warren Jeffs a major defeat in its multi-million-dollar property trust battle. The "Tribune" says the Utah Supreme Court reinforced its decision made in 2010 that Jeffs' Fundamentalist Church of Jesus Christ of Latter-Day Saints simply waited too long to challenge takeover of the 114-million-dollar trust. The trust holds nearly all land, homes and property in the sect's home base in Hildale and Colorado City, Arizona. The ruling likely paves the way for the trust to remain under Utah state control.

(Salt Lake City, UT) -- A Salt Lake City activist who was instrumental in bringing the Olympic Games to town is dead. Jack Gallivan - the longtime publisher of the "Salt Lake Tribune" - died yesterday at the age of 97. Gallivan is also credited with helping bring the Jazz to Utah and for boosting statewide tourism. Funeral arrangements were still pending.

(Willard, UT) -- A man is dead in Box Elder County following a wreck involving a semitrailer along Interstate 15. Authorities say the accident happened early yesterday evening near mile-marker 355 in Willard, Utah. Highway Patrol say a semi was stopped along the side of the highway when it suddenly got rear-ended by the victim. The identity of the victim wasn't immediately known.

>>Men Burned On Boat Recovering

(Salt Lake City, UT) -- Two men are recovering from burns suffered during a flash fire aboard a shrimp boat. Authorities said the men were about to go looking for brine shrimp when a fire started in the boat's engine. One of the two men suffered very severe burns, while the boat suffered minor damage.

>>Principal Apologizes For Homecoming Hemline Drama

(Stansbury Park, UT) -- Stansbury High School will have to stage a free homecoming dance after a hemline debacle sent several girls home from the dance over the weekend. The school's principal apologized to the students Monday for an ambiguous dress code. Numerous girls, wearing dresses at or just above the knee, were turned away from the homecoming dance Saturday because educators believed the dresses were too short.

(Salt Lake City, UT) -- A candidate for Salt Lake County Mayor has been ordered to return some campaign contributions. The district attorney has said that Republican candidate Mark Crockett violated campaign finance rules. Crockett needs to return the funds or he could face criminal charges. Crockett told FOX-13 that the whole thing is a misunderstanding.

(Lehi, UT) -- Shovels broke ground yesterday on what will become the state's largest children's museum. The multi-million-dollar project will go up at Thanksgiving Point on a five-acre piece of land. The Museum of Natural Curiosity will feature 150 exhibits. It is expected to be complete in 2014.

(Provo, UT) -- Rescue crews in Provo are working to retrieve a base jumper caught dangling high in the air from a canyon cliff. Utah County Sheriff's officials say the base jumper's parachute apparently got snagged on a cliff face near the mouth of Provo Canyon a little before 8 p.m. The cliff is believed to be one-thousand-feet above ground and crews were trying to determine the best way to get the jumper.

KSL-TV cites a new poll by Dow Jones which has Republican candidate Mia Love leading Democratic Representative Jim Matheson by a margin of six-points. With a margin of error of five-percent experts say the election will likely be too close to predict.

(Midvale, UT) -- Officials with Salt Lake City's downtown homeless shelter Road Home are opening their winter facility in Midvale earlier than usual. The Midvale facility is where more than 60 families can find safe and temporary housing during the bitterly-cold winter months. The Midvale home was formerly where overflow families would be housed.

The reported a massive search effort by the Grand County Sheriff's office with the aid of Moab Police, volunteer firefighters and search and rescue team members. A research of the home, however found the girl inside the home but hidden from the first search asttemp. She is ok.
